Call to Order

 

The Policy Review Committee met on Friday, August 6, 2008 at 12:10 PM at the Lincoln Center, 415 North 30th Street, Billings, Montana.

 

The meeting was chaired by Katharin Kelker.

 

Those present included: Trustees Katharin Kelker, Joel Guthals and Mary Jo Fox. Also present were Leo Hudetz, Clerk, Dan Martin, Director of Human Resources, Dave Williams, Director of Activities and Jeff Greenfield, BEA representative.

 

 

Policy 1700

 

Chair Kelker summarized the proposed changes to Policy 1700, the Uniform Complaint Procedure. She stated that the proposed changes would eliminate job performance complaints from Policy 1700. Joel Guthals and Mary Jo Fox said there should be a way to address complaints against teachers and coaches. Mary Jo Fox suggested that some independent person review these types of complaints.

Dave Williams explained the current method of handling complaints against coaches. He pointed out that very often a coach is disciplined as a result of a complaint, but due to privacy issues, the complainant or any other member of the public will not know how the situation was handled.

The committee asked Dave Williams if complainants receive a fair, unbiased hearing. Mr. Williams stated that he believed that each complaint is reviewed and handled in a fair and unbiased way.

Chair Kelker suggested that a form be developed that chronicles each step taken in reviewing a particular complaint. Dan Martin concurred with this idea and also recommended that a complainant should be given the opportunity to take his or her complaint directly to the Superintendant if they believe a fair hearing would not be possible otherwise. Chair Kelker stated that a new policy and procedure should be developed to handle job performance complaints. Chair Kelker said she would draft a policy and asked that Dan Martin and Dave Williams draft a related procedure and form. Chair Kelker asked Leo Hudetz to ensure that the District website be updated with the policy, procedure and form so that the public would have easy access to it. Mary Jo Fox asked that the new policy and Policy 1700 contain cross references to each other in the policy manual. The proposed policy and procedure will be reviewed at the next Policy Review Committee meeting and then sent to the Board of Trustees for first reading.

 

Joel Guthals asked Mary Jo Fox if her concerns were addressed with the committee’s plan. Mary Jo Fox answered yes provided that the new policy and/or procedure allow an avenue for complainants to go directly to the Superintendant when certain extenuating circumstances are present that prevents a fair hearing at a lower level. The policy should allow the Superintendant to decide if the complaint warrants an independent investigation.

 

Minutes

 

Mary Jo Fox moved to approve the minutes of the May 30, 2008 Policy Review Committee meeting. Joel Guthals seconded. The motion passed unanimously.

 

 

The committee adjourned at 1:15 PM.
