Monday, August 7, 2006

 

Call to Order

 

A Special Meeting of the Board of Trustees of the Billings Elementary School District No. 2 and the Board of Trustees of the Billings High School District No. 2 was held in the Board room in the Lincoln Center, 415 North 30th Street, Billings, Montana, on Monday, August 7, 2006, at 6:30 p.m.

 

Chair Malcolm Goodrich presided and led those present in the Pledge of Allegiance.

 

Roll Call

 

The following Trustees were present: Malcolm Goodrich, Katharin Kelker, Mary Jo Fox, Sandra Mossman, Dawn Achten, Dale Getz, Rachel Stagg, and Joel Guthals. Also present were: Superintendent Jack Copps, District Clerk Leo Hudetz, Secondary Education Director Scott Anderson, West High Assistant Principal Gordon Klasna, and Jeff Weldon, legal counsel. Lewis and Clark Principal Steve Pomroy and Lewis and Clark Assistant Principal Lance Orner joined the meeting for items 2 and 3 below.

 

Communication from the Public

 

The Chair stated that anyone wishing to comment to the Board is welcome and encouraged to do so. There were no members of the public present and therefore no public comments.

 

Expulsion Hearings

 

Jeff Weldon briefed the Board on Montana expulsion and suspension law. The discussion included considerations of due process, expulsion hearing protocol, the standard of evidence applicable in such cases, and District policies concerning student discipline.

 

1. BPS Case No. Exp-2005-06-18. Chair Goodrich stated that the Board would now consider a student disciplinary matter. He determined that the discussion related to a matter of individual privacy that clearly exceeded the merits of public disclosure and he closed the meeting. He asked all persons present other than the student, parents of the student, or legal representatives of the student and representatives of the District’s administration to leave the room. The Trustees, Superintendent Copps, Director Anderson, Assistant Principal Klasna, and Counsel Weldon remained in the room. Neither the student nor the student’s parents were present.

 

After the hearing on this matter, the Board reconvened in open session.

 

Trustee Guthals moved to accept the Superintendent’s recommendation to expel permanently the student in case number Exp-2005-06-18. Trustee Achten seconded the motion. The motion passed unanimously.

 

The Board expressed its appreciation to Assistant Principal Klasna for his work on this matter and for his preparation for the hearing.

 

The Chair announced that the remaining two matters pertained only to the Elementary District Board, and Trustee Guthals was excused from the meeting. Assistant Principal Klasna also excused himself from the meeting.

 

2. BPS Case No. Exp-2005-06-36. Chair Goodrich stated that the Board would now consider a student disciplinary matter. He determined that the discussion related to a matter of individual privacy that clearly exceeded the merits of public disclosure and he closed the meeting. He asked all persons present other than the student, parents of the student, or legal representatives of the student and representatives of the District’s administration to leave the room. The Trustees, Superintendent Copps, Director Anderson, Principal Pomroy, Assistant Principal Orner, and Counsel Weldon remained in the room. Neither the student nor the student’s parents were present.

 

After the hearing on this matter, the Board reconvened in open session.

 

Trustee Fox moved to accept the Superintendent’s recommendation to expel permanently the student in case number Exp-2005-06-36. Trustee Kelker seconded the motion. The motion passed unanimously.

 

The Board expressed its appreciation to Principal Pomroy and Assistant Principal Orner for their work on this matter and for their preparation for the hearing.

 

3. BPS Case No. Exp-2005-06-37. Chair Goodrich stated that the Board would now consider a student disciplinary matter. He determined that the discussion related to a matter of individual privacy that clearly exceeded the merits of public disclosure and he closed the meeting. He asked all persons present other than the student, parents of the student, or legal representatives of the student and representatives of the District’s administration to leave the room. The Trustees, Superintendent Copps, Director Anderson, Principal Pomroy, Assistant Principal Orner, and Counsel Weldon remained in the room. The student, the student’s mother, the student’s father, and the student’s stepfather were present and remained in the room. The student’s mother indicated that she anticipated that her attorney would attend the hearing. The Chair directed the Clerk to wait outside the meeting room, watch for the attorney, and bring the attorney in if the attorney arrived. The attorney did not attend the meeting.

 

After the hearing on this matter, the Board reconvened in open session.

 

Trustee Kelker moved to continue the long term suspension of the student in case number Exp-2005-06-36 through January 2007 and to consider the Superintendent’s recommendation to expel the student before the expiration of the long term suspension. Trustee Achten seconded the motion. The motion passed with Trustees Goodrich, Kelker, Fox, Mossman, Achten, and Stagg voting in favor and Trustee Getz voting against.

 

Adjournment

 

As there was no further business, the meeting adjourned at 11:00 p.m.
