February 12, 2007

 

Call to Order

 

The Special Meeting of the Board of Trustees of School District No. 2, Yellowstone County, Montana, and High School District, Yellowstone County, Montana, was duly held at The Lincoln Center, 415 North 30th Street, Billings, Montana, February 12, 2007, at 5:15 p.m.

 

Those present included: Trustees Katharin Kelker, Sandra Mossman, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Dawn Achten, Joel Guthals via phone, Superintendent Jack Copps, and District Clerk Leo Hudetz. Susan Messerly was absent.

 

Communication from the Public

 

The Board recognizes the value of public comment on educational issues and the importance of listening to members of the public in its meetings. The Board also recognizes the statutory and constitutional right of the public to participate in governmental operations. The Board encourages members of the public to participate in and express opinions about issues important to the District. This part of the board’s meeting is dedicated to public comment on any public matter that is not on the agenda of this meeting and is within the jurisdiction of the Board of Trustees. Members of the public may also address particular items on this agenda either now or at the time the Board considers the particular item. There were no public comments.

 

Appoint Panel for Hearing

 

The Chair suggested that he and Trustees Kelker and Guthals serve on a panel to hear a personnel matter. Trustee Kelker and Trustee Guthals agreed to serve on the panel, which will be scheduled at a later date. Trustee Getz made the following motion with a second by Trustee Kelker:

 

Motion to approve the three panel members to hear a personnel matter consisting of Malcolm Goodrich, Joel Guthals, and Katharin Kelker.

 

Those voting in favor were Dawn Achten, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Joel Guthals, Katharin Kelker and Sandra Mossman. The motion passed unanimously.

 

Resolution – Declaration of Vacancy – Elementary Trustee of Single Member District, No. 4

 

Trustee Kelker made the following motion with a second by Trustee Fox:

 

Motion to adopt the Resolution of Declaration of Vacancy of the position of Elementary Trustee of Single Member district, number 4.

 

Those voting in favor were Dawn Achten, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Katharin Kelker and Sandra Mossman. The motion passed unanimously. Joel Guthals is ineligible to vote on elementary issues. The resolution is as follows:

 

WHEREAS, pursuant to Montana law, any elected trustee position shall be vacant whenever the incumbent resigns from the applicable district;

 

WHEREAS, Rachel Stagg, School District No. 2 Elementary Trustee of Single Member District, Number 4, has submitted her resignation from the Board of Trustees January 31, 2007; and, became effective on February 3, 2007 in accordance with Board Policy 1112.

 

THEREFORE, School District No. 2 Board of Trustees accepts the resignation of Rachel Stagg and declares the position of Elementary Trustee of Single Member District, Number 4 as vacant.

 

That this declaration is made pursuant to MCA 20-3-308 and 20-3-309 and School District No. 2 Board Policy 1112.

 

The Chair stated that, according to Board policy, the acceptance of the resignation and declaration of vacancy must be conducted at the next regular Board meeting. Trustee Kelker made the following motion with a second by Trustee Fox:

 

Motion to suspend the rules and policies of the Board so that the business of declaring the trustee position vacant, calling for a trustee election, and appointing a new member of the Board of Trustees can carry on at this Special Meeting.

 

Those voting in favor were Dawn Achten, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Katharin Kelker and Sandra Mossman. The motion passed unanimously. Joel Guthals is ineligible to vote on elementary issues.

 

 

Resolution Calling for an Elementary Trustee Election by Single Member district, No. 4 – May 8, 2007

 

Trustee Kelker made the following motion with a second by Trustee Getz:

 

Motion to adopt the resolution calling for an Elementary Trustee Election by Single Member District, Number 4, to be held on May 8, 2007.

 

Those voting in favor were Dawn Achten, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Katharin Kelker and Sandra Mossman. The motion passed unanimously. Joel Guthals is ineligible to vote on elementary issues. The following is the resolution:

 

WHEREAS the trustees of any district shall have the authority under the provisions of section 20-20-201, MCA, to call for a school election and;

 

WHEREAS an election of trustees shall be conducted annually on the regular school election day, the first Tuesday after the first Monday of May;

 

WHEREAS on January 31, 2007, the trustees of Yellowstone County School District No. 2, and High School District No. 2, called for a trustee election for Elementary Single Member Districts numbered 3, 5, and 7 and High School District A (Lockwood);

 

WHEREAS subsequent to this call for an election the trustee position for Elementary Single Member District 4 has become vacant;

 

THEREFORE BE IT RESOLVED that the trustees of School District No. 2, Yellowstone County, call for an election of the registered electors of the district to be held on the 8th day of May, 2007, for the purpose of electing one (1) elementary trustee by single-member district numbered four (4). This position shall be for a two-year term. If it is later determined that any portion of the election is not required, the Board of Trustees authorized the Yellowstone County Election Administrator to cancel that portion of the election in accordance with 13-1-304 and 20-3-313, MCA. Polls are to be open from 7:00 a.m. until 8:00 p.m. on the said day of the election. Judges and polling places to be established by the Yellowstone County Election Administrator.

 

Resolution of Appointment – Position of Elementary Trustee of single Member District, Number 4

 

Trustee Getz made the following motion with a second by Trustee Kelker:

 

Motion to adopt the Resolution of Appointment to the position of Elementary Trustee of Single Member District,

Number 4.

 

Those voting in favor were Dawn Achten, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Katharin Kelker and Sandra Mossman. The motion passed unanimously. Joel Guthals is ineligible to vote on elementary issues. The resolution is as follows:

 

WHEREAS, pursuant to Montana law, whenever a trustee position becomes vacant in any district, the remaining members of the trustees shall declare such position vacant and they shall appoint, in writing within 60 days, a competent person as a successor, and

 

WHEREAS, the School District No. 2 Board of Trustees has declared the position of Elementary Trustee of Single Member District, Number 4 as vacant;

 

THEREFORE, we the Board request interested applicants do apply for the vacated position of Elementary Trustee of Single Member District, Number 4. The application deadline shall be February 28, 2007 and the successor shall be appointed by March 19, 2007 and shall serve until the regularly scheduled election May 8, 2007. District Clerk, Leo Hudetz, shall receive applications and submit them to the Board.

 

That this appointment is made pursuant to MCA 20-3-09 and School District No. 2 Board Policy 1112.

 

Appoint Ad Hoc Subcommittee of Board

 

Clerk Hudetz reported a subcommittee of Board needs to be appointed to interview and recommend a new Elementary Trustee for Single Member District Number 4. Trustees Achten, Fox and Getz volunteered to serve on the subcommittee. Trustee Kelker made the following motion with a second by Trustee Mossman:

 

Motion to approve committee members of Dawn Achten, Mary Jo Fox, and Dale Getz to interview candidates of the Trustee vacancy.

 

Those voting in favor were Dawn Achten, Mary Jo Fox, Dale Getz, Malcolm Goodrich, Joel Guthals, Katharin Kelker and Sandra Mossman. The motion passed unanimously.

 

As there was no further business, the meeting adjourned at 5:22 p.m.
