May 17, 2007

 

Call to Order

 

The Special Meeting of the Board of Trustees of School District No. 2, Yellowstone County, Montana, and High School District, Yellowstone County, Montana, was duly held at The Lincoln Center, 415 North 30th Street, Billings, Montana, May 17, 2007, at 5:00 p.m.

 

Those present included: Trustees Joel Guthals, Katharin Kelker, Dale Getz, Susan Messerly, Kathy Aragon, Malcolm Goodrich and District Clerk Leo Hudetz. Trustee Mary Jo Fox arrived at 5:45 p.m. Superintendent Jack Copps, Trustees Achten, and Sandra Mossman were excused.

 

Communication from the Public

 

The Board recognizes the value of public comment on educational issues and the importance of listening to members of the public in its meetings. The Board also recognizes the statutory and constitutional right of the public to participate in governmental operations. The Board encourages members of the public to participate in and express opinions about issues important to the District. This part of the board’s meeting is dedicated to public comment on any public matter that is not on the agenda of this meeting and is within the jurisdiction of the Board of Trustees. Members of the public may also address particular items on this agenda either now or at the time the Board considers the particular item. There were no public comments.

 

Farewell to Retiring Trustees

 

The Chair thanked Trustees Getz and Messerly for their service and presented them with gifts.

 

Canvass of Votes – May 8, 2007 – H. S. Trustee Nominating District A (Lockwood), and High School Mill Levy

 

Trustee Guthals made the following motion with a second by Trustee Getz:

 

Motion to approve the canvass of votes from the May 8, 2007 Election, High School Trustee Nomination

District A (Lockwood), and High School Mill Levy.

 

Those voting in favor were Kathy Aragon, Dale Getz, Malcolm Goodrich, Joel Guthals, Katharin Kelker and Susan Messerly. The motion passed unanimously. The following are the election results:

 

High School Trustee Nominating District A – (Lockwood) – 2 Year Term

High School Mill Levy Election

Votes For 13,651

Votes Against 10,295

 

Canvass of Votes – May 8, 2007 – HS/Elementary Trustee by Single Member District 5, and Elementary Mill Levy

 

Trustee Kelker made the following motion with a second by Trustee Getz:

 

Motion to approve the canvass of votes from the May 8, 2007 Election, HS/Elementary Trustee Single District 5, and Elementary Mill Levy.

 

Those voting in favor were Kathy Aragon, Dale Getz, Malcolm Goodrich, and Katharin Kelker. The motion passed unanimously. Joel Guthals and Susan Messerly are ineligible to vote on elementary issues. The following are the election results:

 

HS/Elementary Trustee by Single Member district – 3 Year Term

Administering Oaths and Reorganization of the Board

 

District Clerk Hudetz reported Timothy Trafford has accepted to fill the position of High School Trustee of Nominating District A (Lockwood). He further stated that Peter Gesuale has made his intention known to take the position vacated in the elementary district (Single Member District 5) but was unable to attend this evening and will be sworn in at a later date.

 

A.J. Micheletti, County Superintendent, administered the oath of office to Kathy Aragon, Malcolm Goodrich, and Tim Trafford.

 

Chair Goodrich stated he was willing to serve again in the capacity of Board Chair and Vice-Chair Kelker has also stated she would be willing to continue as Vice-Chair. District Clerk asked for nominations for Chair and Vice-Chair. Trustee Guthals nominated Malcolm Goodrich as Chair and Katharin Kelker as Vice-Chair for the upcoming year. Trustee Kelker seconded the nomination.

 

Those voting in favor were Kathy Aragon, Malcolm Goodrich, Joel Guthals, Katharin Kelker and Tim Trafford. The motion passed unanimously.

 

The Chair asked Leo Hudetz if he was willing to continue serving as District Clerk. Mr. Hudetz reported he was. Trustee Kelker made the following motion with a second by Trustee Guthals:

 

Motion that we, once again, have Leo Hudetz serve as Clerk of the Board.

 

Those voting in favor were Kathy Aragon, Malcolm Goodrich, Joel Guthals, Katharin Kelker, and Tim Trafford. The motion passed unanimously. The Chair administered the oath of office.

 

At this time, the retiring Board members left and the new Board members assumed their positions as Trustees.

 

Use of Donated Funds to Rebuild West High Track

 

Dennis Sulser, West High Principal, reported a group has worked for over a year to raise funds to build a new track at West High School. There have been several donors from the community step forward. Mr. Sulser said they have either raised or received pledges of $286,000 with a projected cost at $263,160 for the track. Commitments have been made from the community. Jim Harris, Yellowstone Bank, has committed $100,000 and has been given naming rights for the track. Two commitments of $25,000 each have been received from other businesses, Aaron’s and Rimrock Motors, to name two running lanes. A grant was received from Nike Corporation for $50,000. Mr. Sulser was seeking permission from the Board to begin construction. Other donors were Exxon, Orthopedic Surgeons, CMG Construction, Johnson Lane Materials, Fischer Sand and Gravel, Dr. Patrick Cobb, Stewart Geological, Engineering Inc., and Conoco Phillips . The Relay for Life in July will be able to stay at West High and the construction timeline will allow that to happen. Mr. Sulser also thanked Jeff Muri for beginning the fund raising efforts and Rob Stanton, Track Coach, for his hard work.

 

Rich Whitney, Facilities Director, reported the base bid is $273,160 and the removal of the testing costs of $5,000 and the contribution from CMG of $5,000, bring the final base bid to $263,160. The West High Boosters still have an obligation to raise $78,600, which is what will cost to put the rubber service over the asphalt.

 

The Chair thanked the Harris family and all of the contributors on behalf of the community for the generous contributions. Dennis Sulser reported the track will be named The Yellowstone Bank Track at West High and recognition will be on 24th Street. Rich Whitney reported the Activities Office is putting $40,000 from student fees toward the track project. Trustee Guthals made the following motion with a second by Trustee Kelker:

 

Motion that the Board authorize and approve that the West High track facility be remodeled and rebuilt and further move that the construction costs be paid from donated funds with the exception of up to $40,000 to be paid from the accumulated student activity fees.

 

Those voting in favor Kathy Aragon, Malcolm Goodrich, Joel Guthals, Katharin Kelker and Tim Trafford. The motion passed unanimously.

 

Trustee Fox arrived and was administered the oath of office by County Superintendent of Schools, A. J. Micheletti.

 

Beartooth – New Roof Top Units/2007

 

Rich Whitney reported the project to put new roof units on Beartooth was presented to the Budgeting for Results Committee and was recommended by that committee on Monday evening. Fisher Construction was the low bidder at $252,000. This is the minimal amount to get the building open and ready for use in the fall as an elementary school. Trustee Kelker made the following motion with a second by Trustee Aragon:

 

Motion to approve the two new roof top units for Beartooth.

 

Those voting in favor were Kathy Aragon, Mary Jo Fox, Malcolm Goodrich, and Katharin Kelker. The motion passed unanimously. Joel Guthals and Tim Trafford are ineligible to vote on elementary issues.

 

Castle Rock Middle School Reroof – 2007

 

Rich Whitney stated $40,000 has been received from the insurance company from the damage to Castle Rock Middle School. The section that was damaged is the only portion that had not been replaced since Castle Rock was built. Summit Roofing was the low bidder at $814,128. Trustee Kelker made the following motion with a second by Trustee Fox:

 

Motion to approve the project to reroof Castle Rock Middle School.

 

Those voting in favor were Kathy Aragon, Mary Jo Fox, Malcolm Goodrich, and Katharin Kelker. The motion passed unanimously. Joel Guthals and Tim Trafford are ineligible to vote on elementary issues.

 

Clean Renewable Energy Bonds

 

Trustee Guthals explained that Board authorization is needed for the District to take initial action to apply for Clean Renewable Energy Bonds (CREBs) on or before July 13, 2007. He suggested $3,000 of Board contingency be used to engage Matney-Frantz Engineering of Bozeman to consult and draft required applications. The Board would then review and approve any applications before they are filed. CREBs are authorized under the federal Energy Policy Act of 2005 and by HB330 that was adopted by the Montana Legislature during the 2007 regular session and signed into law by the Governor. The cost of a feasibility study is $5,000. Trustee Guthals stated wind energy is feasible and interest free bonds would be payable over a period of sixteen years. He asked for authorization from the Board to move forward.

 

Trustee Kelker made the following motion with a second by Trustee Aragon:

 

Motion that the Board give permission for the firm of Matney-Frantz Engineering to do the initial application for Clean Renewable Energy bonds for the District up to the cost of $3,000.

 

Those voting in favor Kathy Aragon, Malcolm Goodrich, Joel Guthals, Katharin Kelker and Tim Trafford. The motion passed unanimously.

 

As there was no further business, the meeting adjourned at 6:12 p.m.
