August 9, 2007

 

 

 

Call to Order

 

The Policy Review Committee met on Thursday, August 9, 2007 at the Lincoln Center, 415 North 30th Street, Billings, Montana.

 

The meeting was chaired by Malcolm Goodrich and called to order at 5:00 p.m.

 

Those present included: Trustees Malcolm Goodrich, Katharin Kelker and Mary Jo Fox. Also in attendance were Superintendent Jack Copps, Clerk Leo Hudetz, Attorney, Jeff Weldon, Human Resource Director, Dan Martin, Director of Secondary Education, Scott Anderson and Glenn Kanvick.

 

The committee discussed the following items:

 

Approval of Minutes

The minutes from the July 13, 2007 meeting were presented. Malcolm Goodrich moved and Katharin Kelker seconded that minutes be approved. Those voting in favor were Katharin Kelker, Malcolm Goodrich and Mary Jo Fox. Motion passed unanimously.

 

Policies 5007, 5008, 9315

Discussion was held regarding changes in Policies 5007, 5008 and 9315. Katharin Kelker reviewed changes that she proposed.

 

Malcolm Goodrich informed the committee that he visited with Jeff Greenfield of the Billings Education Association about Policy 5007. Because they are ready to file an unfair labor practice, Mr. Greenfield recommended that the district suspend the present policy and move forward to negotiate a new policy.

 

Jeff Weldon recommended that the policy not be suspended but direct the Superintendent not to enforce the policy pending its review.

 

Trustee Malcolm Goodrich made the following motion with a second by Trustee Fox .

 

Motion that the Policy Review Committee recommends that Leo Hudetz and Jeff Weldon work on revising policies 5007, 5008 and 9315. Until these new policies are approved by the Board of Trustees, the Superintendent will not enforce the bulleted items under “As a condition of employment…”on the bottom of page one of Policy 5007 as long as it is not in conflict with Federal or State Law.

 

Those voting in favor were Malcolm Goodrich, Katharin Kelker and Mary Jo Fox. The motion passed unanimously.

 

 

 

 

 

Bomb Threat Policy

 

Trustee Mary Jo Fox asked the committee that a separate section for bomb threats discipline be added to the Student Discipline Policy 3250. Leo Hudetz and Jeff Weldon will work on this section.

 

Trustee Goodrich suggested adding a section to the Student Discipline section of Policy 3250 which would specify bomb threats as an action that would have discipline consequences.

 

Trustee Kelker made the following motion with a second by Trustee Mary Jo Fox .

 

Motion that the Policy Review Committee recommends that Leo Hudetz and Jeff Weldon draft additions to the policy 3250 on student discipline to include another lettered item referring to bomb threats with a complete description of a bomb threat and an additional paragraph regarding bomb threats and discipline be added to Policy 3250 with language similar to the Gun Free Schools section.

 

Those voting in favor were Malcolm Goodrich, Katharin Kelker and Mary Jo Fox. The motion passed unanimously.

 

Policy 1700 Appeal Hearing

Malcolm Goodrich explained the State of Montana privacy law to Glenn Kanvick, the complainant, and declared this to be an open meeting. Mr. Kanvick said he understood why this appeal hearing was required to be an open meeting.

 

Glenn Kanvick explained his complaint and told the committee that he was not familiar with the 60 day limitation on filing a complaint. He said he has not received an answer from the Career Center where he works if he will be reimbursed for his petty cash expenses.

 

Leo Hudetz explained that anyone making a complaint under 1700 has to make it either within 30 days of the incident or if an attempt was made to resolve the matter informally they have sixty days. According to Mr. Kanvick’s complaint, the last incident occurred on January 11, 2007. The actual complaint came into Leo Hudetz’s office April 11, 2007 and was therefore beyond the 60 day timeline.

 

Mary Jo Fox asked Mr. Kanvick if he has received any answer from administration on the complaint and Mr. Kanvick said no.

 

Dan Martin explained to the committee the district’s procedure for using petty cash funds in the schools.

 

Trustee Katharin Kelker made the following motion with a second by Trustee Fox .

 

Motion that the Policy Review Committee recommends that the complainant withdraw his previous 1700 complaint and file another Policy 1700 complaint if after making another attempt to be reimbursed for petty cash he is unsuccessful.

 

The committee affirms that the ruling by Leo Hudetz that the original Policy 1700 complaint was not timely filed.

 

Those voting in favor were Malcolm Goodrich, Katharin Kelker and Mary Jo Fox. The motion passed unanimously.

 

 

 

 

Meeting was adjourned at 6:45.p.m.

 

Next meeting will be held on September 7, 2007 at 12:00 noon.
